False Patent Marking Settlements
Currently Range from $500 to $350,000
A previous post noted that a law suit for false
patent marking could be expensive.
A post by the patent law blog Patently-O on March 15, 2011, indicated that
several of the false marking lawsuits have been settled for an average
settlement of $53,404 and a median settlement of $40,000, with the lowest
settlement being $500 and the largest settlement being $350,000. It appears that at least 820 false
marking lawsuits are still pending.
Thus, these settlement numbers are likely to change. The post by Patently-O can be
